Attorney Grievance & Judicial Disability

Attorney Grievance

If you are an attorney that has received a letter from the Office of Bar Counsel concerning an inquiry in to potential violations of the Maryland Attorneys’ Rule of Professional Conduct, contact our law firm right away to speak to an experience attorney.

Responding to Bar Counsel’s inquires at the initial stage of an investigation is critical, and can often lead to a quick end to an issue. Our attorneys have successful fended off further inquiry by Bar Counsel at this initial stage with a carefully crafted response and defense to any alleged misconduct.

Our law firm has successfully defended attorneys at every stage of the Attorney Grievance process, including during the initial investigation phase, the peer review process, evidentiary hearings, and disposition before the Maryland Court of Appeals.

In addition, our law firm has successfully negotiated numerous cases with bar counsel, and obtained diversion agreements, dismissals, and reprimands for our clients.

Judicial Disability

When a complaint is filed against a judge, it is filed with the Maryland Commission on Judicial Disabilities. The Commission is an independent body that is responsible for investigating complaints. The Commission may also conduct hearings, take certain actions, or make recommendations to the Court of Appeals. The Commission's jurisdiction is isolated to complaints about alleged sanctionable conduct, disability, or impairment of a Maryland judge.

Any individual may file a complaint against any Maryland judge sitting in any of the following courts:

  • Circuit Court
  • Court of Appeals
  • Court of Special Appeals
  • District Court
  • Orphans' Court

If you are a Maryland judge under investigation by the Commission, contact Brennan McKenna & Lawlor right away. Our attorneys have extensive experience handling judicial disability cases, and we are prepared to help you with your case today.
